Applying, joining Discord, reading this page or receiving portal access is not an order or acceptance. This page is the public brief and proposed standard agreement. Sections 1–13 apply to a collaboration only when both parties expressly incorporate this exact version into a completed written mission. The mission must settle the items marked for confirmation before work starts; later edits to this public page do not amend an accepted mission. How the collaboration works • Join Fiava’s Discord server as a step in becoming a creator. Meet other creators, ask questions and get help before your first collaboration. • Agree one mission. Fiava and you confirm the creation, approved account handles, language, posting plan, assets, measurement evidence, deadlines, rights and payment details in writing. • Confirm the production materials and access. Fiava supplies the approved watermark/logo assets, ready-made CTA selection, placement instructions and any walkthroughs available for that mission. Use only the actual files and versions supplied. • Make your main video with your existing tools. Integrate the agreed promotion without changing your characters or implying that Fiava made a video produced elsewhere. • Send the draft and caption for the agreed review. Resolve objective issues against the written brief and get the publication approval before posting. • Publish on the approved accounts, send each public post URL and its actual publication time, and preserve native analytics for the shared measurement cutoff. • Submit the agreed native evidence through the private method Fiava confirms. Fiava reviews it, explains the eligible-view calculation and sends the amount due by the stated payment deadline, subject to timely evidence and payment details. Private access at creators.fiava.ai and any supported submission, evidence, earnings or payment workflows must be confirmed in your invitation. Do not assume a dashboard, automatic view tracking or live verified earnings is available. Manual native-analytics submission and human review can be the agreed workflow. Personalized CTA generation featuring your characters is not currently enabled; ready-made CTAs are the starting option, subject to Fiava supplying the approved assets. If Fiava later enables a personalized CTA workflow for your mission, the written schedule will identify its availability, credit allowance, expiry and support process first. Those credits are only for the approved promotional CTA, not unlimited main-video generation or cash. Your practical creative brief What to make and where to post Make the AI fruit story described in your mission, in the agreed language and format. The schedule identifies one creation, every approved TikTok or Instagram account, the number of posts, draft deadline, publication window and contact for approval. No duration, extra platform, post or revision is implied when it is absent from the agreed deliverables. Use the supplied promotion accurately • Watermark and logo: use the approved file and permitted variant without distortion. Proposed placement, for confirmation in the mission: keep it legible against the footage, clear of subtitles, important action and platform buttons, and visible for the agreed part of the video. Fiava must confirm the safe area, size, contrast and duration against the actual mobile preview; no pixel specification is supplied by this public page. • CTA: use the selected ready-made clip, or a personalized clip only if that workflow and allowance are expressly available in your mission. Confirm the CTA position, duration, transition, audio and permitted edits before production. • Caption and tracking link: use the exact approved wording, destination and placement supplied in the mission. If a required link or asset has not been supplied, request it before publishing; do not invent a URL or replace it with a personal affiliate link. • An appropriate CTA is “Create your own AI stories with Fiava”. A main video made elsewhere must not say “Made with Fiava”. A Fiava-generated CTA does not make the entire main video Fiava-generated. • Describe only features and personal experiences you can support. Do not promise earnings, results, free access or product capabilities that Fiava has not approved and actually provides. Make the paid relationship clear Use a clear disclosure such as “Ad: paid partnership with Fiava”, translated into the same language as the promotion. Put it where viewers encounter the endorsement: visibly in the video when the promotion begins and near the start of the caption, before any “more” fold. Give viewers time to read it; also say it aloud when the endorsement is spoken. Use the platform’s applicable paid-partnership/content-disclosure setting in addition to your own disclosure. On TikTok, turn on the content disclosure setting and identify the third-party branded content as a paid partnership. Do not bury disclosure among hashtags. Review, publish and capture insights Send the draft video, caption, disclosure and planned accounts by the scheduled draft deadline. Fiava checks the agreed assets, claims, placement, deliverables and disclosures. Confirm any corrections and the publication approval in writing. After posting, promptly supply each URL and actual publication time. Check the analytics access before launch, capture the agreed evidence through the shared cutoff, and send it by the mission’s evidence deadline. Ask your mission contact or support for help if an asset, technical problem or analytics limitation prevents this process. Rates and cumulative bonuses (USD) Base pay is $1 per 1,000 eligible organic views, paid proportionally with no minimum view threshold and capped at $200 per creation. Each milestone bonus is earned once and adds to every earlier bonus on top of base pay. That maximum requires 1,000,000 eligible organic views during the measurement window. After the base cap, pay increases only at the next bonus milestone: 300,000 eligible views earns $250. There is no additional automatic reward beyond 1,000,000 eligible views. We first add the verified eligible view counts from every approved post of the same creation, calculate base pay once and round it once to the nearest USD cent, with exactly half a cent rounded up. We then add the earned whole-cent bonuses. We do not round each country or platform separately. A very small view count can therefore round to $0.00 without a minimum view threshold; for example, 5 eligible views round to $0.01. Approved TikTok and Instagram posts of the same creation share one calculation, one set of milestone bonuses, one cap and one measurement window. These are aggregated platform views, not a count of unique people. Minor edits, reposts and extra URLs do not create another payable creation without separate written authorization. Compensation version: creator-compensation-2026-09-07. Eligible-market version: creator-markets-2026-09-07. Measurement version: creator-measurement-2026-09-07. The exact accepted document and these rules must be retained with the mission. 43 eligible audience markets Australia, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czechia, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Italy, Japan, Latvia, Lithuania, Luxembourg, Malta, Netherlands, New Zealand, Norway, Poland, Portugal, Qatar, Romania, Saudi Arabia, Singapore, Slovakia, Slovenia, South Korea, Spain, Sweden, Switzerland, Taiwan, United Arab Emirates, United Kingdom, United States. These are the locations of the audience viewing the approved posts, not a creator-residence requirement. Participation and payment availability for you are confirmed separately before acceptance. Only otherwise eligible organic views from these markets count toward both base pay and bonuses. For example, one million total views with 200,000 verified eligible views earns $250, not $400. Views from other markets do not earn base pay or milestone bonuses. View evidence, the 14-day window and payment One shared UTC cutoff The window starts at the actual first approved publication time and ends 14 calendar days later at the same UTC time. Each later approved post contributes only its eligible views from its own actual publication through that shared cutoff. Record the start, cutoff and payment deadline in the mission. Reposting, late URL submission or a second platform does not restart the clock. Later lifetime views do not count. Confirm usable evidence before authorizing work The agreed method is exact native organic post views by country. Before a mission is authorized, Fiava and the creator must confirm that the relevant accounts can supply native analytics showing that metric for each approved post and the required period. A platform may not make it available for every account or format. If it is unavailable, do not authorize a mission using this method or promise that an estimate will later become verified earnings; first agree a usable, separately documented arrangement. • Supply the native export or clear screenshots showing the post identity, organic post-view total, exact country view counts, reporting start and cutoff, and evidence capture time. Capture at or after the cutoff while preserving the correct reporting period. • Country counts must reconcile to the reported organic post-view total without overlaps. Keep countries grouped as “Other” unclassified. Do not allocate them proportionally to eligible countries. • Follower geography, unique viewers, accounts reached, percentages multiplied by total views, estimates and an undated lifetime total are not substitutes for exact post views by country. Any planning estimate must be clearly labeled and is not an approved payout. • Exclude purchased views, bots, artificial view exchanges and paid-ad traffic. Neither party may boost a post without a written method that reliably separates paid views. A sudden spike alone is not evidence of fraud. Human review and reasoned corrections Fiava reviews the native evidence and shares the eligible views, base pay, earned bonuses and any exclusions. If evidence is missing or inconsistent, Fiava identifies the exact issue and asks for the missing material. Missing data is not automatically zero earnings. For unresolved “Other” countries, supported eligible counts can establish an undisputed lower-bound payment while the remaining evidence is reviewed. Section 4 sets out correction and dispute deadlines. Payment is tied to the cutoff Fiava sends payment within the 7 calendar days following the cutoff, normally by day 21, provided the required analytics and payment information are supplied on time. Review does not start a fresh 7-day clock. PayPal or bank transfer is agreed before acceptance, with USD denomination, fees, conversion, invoice requirements, taxes and the secure collection method written in the mission. There is no minimum withdrawal threshold or undisclosed deduction. The proposed evidence deadline is two calendar days after the cutoff, to be confirmed with an exact UTC time in the mission. Supply payment and any required invoice information by that deadline too. Fiava pays supported, undisputed amounts on time. If a specific missing item prevents payment, Fiava explains it and the affected amount; once that item arrives, Fiava sends the newly payable amount within seven calendar days, without delaying amounts already payable. Payment being sent is different from funds arriving: bank or PayPal processing and currency conversion can affect receipt time. 1. Parties, eligibility and contacts The parties are Fiava, Inc., 1209 Mountain Road Place NE, Suite R, Albuquerque, NM 87110, USA (“Fiava”), and the creator identified by legal name and contact details in the accepted mission (“you”). You confirm that you are at least 18, have reached any higher local age of majority, can enter this agreement, and control or have permission to publish on the scheduled accounts. If accepting for a business, you have authority to bind it. Participation and the ability to pay you through the selected method must be confirmed before work is authorized. Your mission names the working contacts for both parties. General support: support@fiava.ai. Formal notices: legal@fiava.ai or Fiava’s postal address above. Keep your mission contact details current. 2. A written mission before paid work A mission is authorized only when both parties confirm its completed schedule and exact agreement version in writing, and Fiava expressly authorizes production. An email exchange can do this: Fiava sends the complete agreement and schedule, you expressly accept both, and Fiava confirms authorization. Retain the complete exchange and attached document. A draft, application, Discord membership or portal invitation alone is not approval. If Fiava provides an activated private acceptance flow in your verified invitation, use the offer-specific link in that invitation and review its attached agreement and schedule. This public page is not that acceptance record. Private portal acceptance is not assumed to be available from this page, and no public button signs a mission. Each additional paid creation needs its own written authorization; one mission creates no recurring order. 3. Deliverables, creative freedom and review You produce the scheduled creation using your usual tools, characters and process, at your usual production cost, and publish only the agreed deliverables on the approved accounts. You retain creative freedom within the written brief. Fiava provides the assets and instructions expressly listed in the mission; production waits for any missing item essential to the brief. Fiava reviews against objective requirements in the accepted brief, including assets, placement, claims, disclosures, deliverables and approved accounts. Unless the schedule agrees otherwise, the proposed standard is one consolidated reasonable correction round for a draft that misses those requirements. Fiava gives the specific reasons and a practical deadline. Personal preference, a new concept, additional deliverables or a second correction round require a written change covering scope, timing and any additional payment before that extra work starts. Silence is not publication approval. If review or a supplied asset is late, the parties move affected deadlines reasonably in writing without treating that delay as your breach. Send publication URLs and actual publication times promptly after approval and posting. Objective approval cannot be withheld solely because sales were disappointing or campaign funds have run out. 4. Compensation, evidence and payment The Rates and cumulative bonuses, 43 eligible audience markets, and View evidence sections above form part of this agreement. The mission retains compensation version creator-compensation-2026-09-07, market version creator-markets-2026-09-07, and measurement version creator-measurement-2026-09-07. Base pay is $1 per 1,000 eligible organic views, proportionally, capped at $200; cumulative bonuses add up to $200. The $400 maximum requires 1,000,000 eligible views within the shared window. There is no guaranteed minimum, additional automatic reward beyond that level or new payable unit for an unapproved repost. Fiava uses only the eligible organic post views supported by the accepted native country-view method, aggregates all approved posts once, rounds base pay once to the nearest USD cent with half a cent upward, and adds each earned milestone bonus once. Both base and bonuses use the same eligible markets. All posts share the first approved publication’s 14-day UTC cutoff and the following 7-day payment deadline. Sales performance and an exhausted campaign budget do not cancel compensation earned under these rules. You submit the specified evidence and payment information by the exact deadlines in the mission. The proposed default is two calendar days after cutoff for evidence, invoice if required, and complete payment details. Fiava gives a reasoned calculation and identifies any missing evidence or excluded traffic. Missing data alone does not establish zero earnings or fraud. Fiava requests corrections and pays the supported, undisputed amount by the original payment deadline; for unresolved “Other” countries, verified eligible counts can support that lower bound. You may request a correction within 14 calendar days of receiving the calculation, identifying the issue and any supporting native evidence. Fiava responds with reasons within seven calendar days. If you need more time to obtain platform records, notify Fiava within those 14 days and agree a reasonable evidence deadline. An unresolved dispute moves to the 30-day discussion process in section 13; it does not leave the calculation in indefinite review. These operational deadlines do not waive mandatory rights or turn a disputed amount into zero. Fiava sends an agreed additional payment within seven calendar days of resolution. If missing evidence, an invoice expressly required by the mission or incomplete payment details actually prevent a particular payment, Fiava states what is needed and why. Fiava sends that newly payable amount within seven calendar days after receiving the missing item, and does not reset the deadline for amounts already supported and payable. You and Fiava cooperate to correct payment errors promptly; a disputed overpayment is not silently deducted from another mission. The schedule states PayPal or bank transfer, USD amounts, who bears each transfer fee, the conversion process and who bears any conversion charge, invoice requirements and any required tax withholding before acceptance. No deduction or withdrawal minimum is created by this public page. Each party handles its own taxes; if Fiava must withhold by law, it explains the basis and supplies the applicable record. Payment records show the USD gross amount, any disclosed lawful deduction, amount sent and sending date. External processing can delay receipt after Fiava sends the payment. 5. CTA assets, access and limited credits Ready-made CTA materials and any private access are limited to the resources actually supplied for your authorized mission. Personalized CTA generation is not currently enabled. If later offered, your mission must first state the supported workflow, approved promotional use, exact allowance and expiry. There is no required paid Fiava subscription, unlimited main-video generation, cash redemption or automatic credit top-up. Keep access personal and secure; do not share credentials, sell credits or use mission resources for unrelated production. Report failed generation or unavailable assets to the mission contact before spending your own money. Fiava will check the failure and agree a workable remedy, such as a supplied CTA, replacement allowance where appropriate, a revised deadline or cancellation under section 10. Technical failure does not authorize extra paid work or require you to purchase a subscription. 6. Costs, promotion spend and other rewards You pay your usual main-video production costs. Fiava owes no additional equipment, software, subcontractor, travel or other expense unless Fiava authorizes the specific expense and amount in writing before it is incurred. Neither party may buy or boost traffic on an approved post without prior written agreement on the spend and a reliable method of excluding paid views. Purchased, bot and artificial-exchange views are ineligible. Creator-program compensation does not automatically stack with affiliate commissions, referral rewards, gifts or another campaign fee. Any combined reward must be expressly confirmed in the mission. No unannounced expense or deduction may be added after acceptance. 7. Publication retention and takedowns Proposed default, to confirm expressly in the mission: keep each approved post publicly available with its agreed promotion for 30 calendar days after that post’s publication. Record each retention end in the schedule. This proposed retention period is separate from the shared 14-day compensation window and does not extend eligible-view measurement. It is not an accepted obligation until confirmed. You may remove or edit a post promptly where law, platform enforcement, safety, harassment, an account-security incident or a credible third-party rights issue reasonably requires it. Notify Fiava promptly when safe and practical, explain the reason and preserve available evidence privately. Fiava may also request a takedown for a specific legal, security or agreed-brief issue. Neither party must keep unlawful or unsafe content online. For an avoidable failure to meet an accepted retention commitment, Fiava first identifies the issue and gives a reasonable opportunity to restore or correct it. A repost requires written approval and does not restart measurement. There is no automatic forfeiture of verified earnings: any financial adjustment must reflect the affected obligation and actual impact, be explained and agreed or resolved through the dispute process. Compensation already earned remains payable where removal follows a permitted exception or Fiava’s cancellation. 8. Ownership and limited sharing rights You retain your rights in your main video, original characters and other creator materials, subject to any rights held by their original owners. Fiava retains its brand assets and supplied materials. Fiava grants you a non-exclusive, non-transferable permission to use the supplied brand assets only for the authorized mission and its agreed publication period. Use of any generated CTA also remains subject to the applicable Fiava service terms; this agreement does not guarantee ownership of third-party material. The proposed standard sharing permission is limited to Fiava linking to the approved public post or sharing it through the platform’s native reshare or embed feature, with creator attribution, for organic promotion while the post remains public. It does not permit downloading the video, re-uploading it, editing it, making derivatives, paid advertising, boosting, whitelisting, Spark Ads, access to your account or use of your identity beyond attribution to the approved post. Each broader use requires a separate written agreement describing the content, channel, territory, duration, edits and payment. Fiava may keep the submitted draft and evidence privately to review, administer and document the mission under its Privacy Policy. That administrative use is not a public reuse license. No password or advertising account permission is required for the standard collaboration. 9. Honest promotion and permitted materials Both parties will use truthful, supportable promotion and comply with the rules that apply to the post. You clearly disclose the paid relationship in the language of the endorsement, in the video and prominently in the caption, and use applicable platform disclosure settings. Fiava will not require a misleading claim, hidden advertisement, false testimonial or statement that a main video produced elsewhere was “Made with Fiava”. A CTA generated with Fiava does not change how the main video was made. You are responsible for having the permissions needed for the music, characters, likenesses, voices, footage and other materials you choose, including their use in a paid promotion. Fiava is responsible for permission to supply its own assets for the agreed use. Flag a credible rights or platform-policy issue promptly and cooperate on a proportionate correction. Do not claim personal experience with Fiava that you have not had. 10. Independence, cancellation and suspension This is a non-exclusive independent collaboration, not employment, agency or a promise of future missions. You may work with other brands and may decline any new mission. There is no ongoing minimum video commitment. Neither party can make commitments on the other’s behalf. Either party may end discussions before written authorization without a production payment. After authorization, a party seeking cancellation must notify the other promptly and limit avoidable further costs. Proposed standard for Fiava cancelling without creator breach before publication: Fiava pays for reasonable documented work already completed, up to the mission’s base-pay cap, and reimburses separately approved non-cancellable expenses. A fixed cancellation amount expressly accepted in the mission takes precedence. This is compensation for authorized work actually done, not an upfront fee or guaranteed minimum for participation. If you cannot complete an authorized mission, tell Fiava promptly; the parties may agree a revised deadline, usable partial deliverable or cancellation and a fair allocation of separately approved costs. For a correctable material breach, the other party identifies it and gives a reasonable opportunity to fix it before cancellation. Immediate suspension is permitted for credible fraud, security, unlawful content or serious rights issues while the facts are reviewed; a view spike by itself is insufficient. If Fiava cancels after approved publication, verified compensation continues to accrue under the accepted rules through the original cutoff while the post remains approved and public, unless both parties agree a replacement settlement. If Fiava requests removal, views earned before removal and any applicable payment for authorized work remain due. Suspension or cancellation never automatically erases earned compensation, and undisputed payments remain due on time. 11. Privacy and confidentiality Fiava handles personal information under its existing Privacy Policy at https://fiava.ai/privacy. Its service Terms are at https://fiava.ai/terms. Supply only the account, evidence, contact and payment information reasonably needed for the mission through the private channel confirmed in your schedule. Do not post bank or PayPal details, identity documents, private agreements, access tokens or analytics in a public Discord channel or an AI prompt. This page’s optional AI tools use the public agreement URL and a prompt about its terms. Each party protects non-public information identified as confidential or reasonably understood to be private, uses it only for the mission, and shares it only with people who need it and must protect it. This does not cover information already public, independently developed or lawfully received elsewhere, and does not prevent legally required disclosure, seeking private professional advice or reporting wrongdoing. Keep no unnecessary private copies; deletion and legally required retention follow the applicable privacy and records obligations. There is no new public-data retention promise in this agreement. 12. Creator community Join the creator Discord server before your first collaboration. You can read this agreement and request help without membership. Joining or applying alone does not accept an agreement or authorize paid work. Approved paid missions, CTA allowances and private account access require separate Fiava approval. Participation does not require gifts, public testimonials or positive reviews. Community discussion cannot amend your payment terms or authorize extra work unless both parties expressly confirm the change through the written mission process. Keep private mission and payment records out of public channels. 13. Responsibility, disputes and changes Each party is responsible for the direct loss it causes by breaching the accepted mission and must take reasonable steps to limit avoidable loss. Proposed standard: neither party owes speculative lost profits or indirect losses, and each party’s ordinary contractual liability for one mission is capped at the greater of $400 or the total compensation payable for that mission. The cap does not reduce amounts Fiava owes for earned compensation or agreed cancellation/expenses, and does not apply to fraud, deliberate misconduct, misuse of confidential information, or liability that cannot lawfully be limited. There is no blanket obligation for a creator to cover all of Fiava’s business risks. Send payment-calculation questions through section 4. For an unresolved dispute, either party may give written notice describing the issue and requested resolution. The parties will try in good faith to resolve it for 30 calendar days from that notice, using legal@fiava.ai and the creator’s mission email. After those 30 days either party may pursue available remedies; urgent protective relief and mandatory legal deadlines need not wait. The process does not suspend undisputed payment or require paid arbitration. The agreement is governed by New Mexico law and applicable United States federal law, without regard to conflict-of-law rules. Courts in Bernalillo County, New Mexico have non-exclusive jurisdiction. Mandatory local rights and any court access that cannot validly be excluded are preserved. If a provision cannot be enforced, the remaining provisions continue to the extent permitted without rewriting the payment bargain. Send formal notices to the contacts in section 1 and the accepted mission, keeping a copy and resolving any delivery failure promptly. A change requires both parties’ express written agreement identifying the mission and the exact changed terms. A public-page edit, dashboard estimate, community message or changed campaign budget does not retroactively amend an accepted mission. If the schedule varies a standard term, it must identify that variation expressly; silence does not replace a stated rate, right or deadline. Keep the exact accepted agreement, completed schedule and approval record together. Reusable mission schedule This is a template to complete together, not an authorized offer. Replace every field with a confirmed value or an explicit “not applicable”, attach the exact agreement and assets, and record both parties’ written acceptance and Fiava’s production authorization before work begins. Final actual publication times then fix the cutoff and payment dates under the accepted rule. Common questions Do I need to pay or switch my video tools? No joining fee or paid Fiava subscription is required. Keep your usual main-video tools and pay your usual production costs. Use the supplied promotion agreed for the mission. Is $400 guaranteed? No. $400 requires 1,000,000 verified eligible organic views during the shared measurement window. There is no upfront payment or guaranteed minimum earnings. For 300,000 eligible views the payout is $250. Can one video earn twice on TikTok and Instagram? Approved posts of the same creation add their eligible platform views into one calculation, cap, bonus schedule and cutoff. They are not separate payable creations and do not represent unique people. What if my audience is partly outside the eligible markets? Only verified organic post views from the listed 43 markets count for either base pay or bonuses. One million total views with 200,000 eligible views pays $250. What if my analytics only show viewers, percentages or Other? Confirm the evidence before accepting. Those metrics cannot replace exact native organic post views by country. Other stays unclassified. If an evidence problem arises after authorization, Fiava asks for what is missing and pays the supported, undisputed amount; missing data is not automatically zero earnings. When is payment sent? Within seven calendar days after the shared 14-day cutoff, normally by day 21, when the agreed evidence and payment information are supplied on time. The mission records exact UTC deadlines and payment costs. Bank or PayPal receipt can be later than the sending date. Does Fiava get my video or advertising-account rights? You retain your rights in your material. The proposed standard allows only attributed organic native reshares, links and embeds while the post is public. Paid ads, downloads, re-edits, re-uploads, broader reuse and account permissions require a separate written agreement. Does reading this page or joining Discord accept a mission? No. A completed written mission, its exact agreement and both parties’ express acceptance are required, followed by Fiava’s authorization to start production. Community membership and private access alone authorize no paid work. Can I use AI to help me understand it? Yes. The optional tools share this public agreement URL and a prompt about its terms. If the service cannot read the whole page, copy and paste the full public text. AI summaries can contain errors and do not change the agreement. Do not paste private schedules, signatures, analytics, payment details or access tokens.
